The Federal Economic Competition Commission (Cofece) presented its activities report, detailing the actions carried out between January and March 2025. Chapter 1 reports the procedures to prevent and correct market structures that hinder, damage, or impede competition and free market access.

Chapter 2 addresses Cofece's actions to fight and deter anticompetitive practices that affect markets. Chapter 3 reports on Cofece's activities to promote the application of competition principles and their benefits among public and private actors.

Chapter 4 reports on actions aimed at consolidating the Commission's organizational model. Finally, Chapter 5 reports on the progress of Cofece's Annual Work Program (PAT, per its initials in Spanish) 2025, which contains 24 strategic actions that contribute to achieving its institutional objectives.

DEFENSE BEFORE THE JUDICIARY

The Federal Judiciary (PJF, per its initials in Spanish) denies AT&T an Amparo against the compliance review resolution sanctioning it for failing to notify a merger.

The First Collegiate Circuit Court Specialized in Economic Competition, Broadcasting and Telecommunications denied the Amparo trial to AT&T Inc., after determining that Cofece, when individualizing the sanctions, is not compelled to consider all the elements settled in Article 130 of the Federal Law of Economic Competition (LFCE per its initials in Spanish). Therefore, the sanction imposed in the amount of 25 million 786 thousand 960 pesos, due to the failure to notify a concentration to Cofece, is according to the law.

In 2022, AT&T, Inc. and other economic agents notified a concentration; however, from the analysis of the information, in June of that year, the Technical Secretary ordered to initiate the procedure due to the possible omission to notify the concentration in question. Therefore, after the  resolution issued by the Board of Commissioners of Cofece on August 25, 2022, AT&T Inc. and other economic agents were sanctioned as their responsibility was accredited following section II of article 86 of the LFCE.

In April, the Commission dealt with 107 matters, of which 63 correspond to mergers, 24 to proceedings for monopolistic practices and unlawful mergers, 5 to special proceedings, and 15 to opinions on bidding processes, concessions, and permits.

Complaints, investigations, and trial-like proceedings

  • 1 complaint was analyzed, 1 of which remained pending at the end of the month.
  • 16 investigations for monopolistic practices and unlawful mergers were followed up.
  • 7 trial-like proceedings were followed up.
  • 5 special procedures were followed up to determine the existence of essential facilities and barriers to competition.

Mergers

  • 63 mergers were monitored, of which 12 were notified during the period. Of these transactions, 17 were authorized, accordingly, 46 remained under analysis at the end of the month.1
  • The amount of authorized transactions was $1,004,102.3 million pesos.

Amparo Trials

  • During March, the Judicial Power resolved 15 amparo trials: 2 were granted, 7 were denied, 1 was granted and dismissed, and 5 were dismissed.2 At the end of the period, 324 trials are still in process, of which 314 correspond to economic competition matters.
