Trial-like Procedure

When the Investigative Authority identifies sufficient evidentiary elements to establish the execution of a monopolistic practice or unlawful concentration, a file is submitted to the Technical Secretariat for the notification to the alleged offender of offenders of a statement of probable responsibility with which the trial-like procedure is initiated.

 In this stage, the alleged offenders have the right to argue in their favor and submit evidence related to the allegations presented against them. Once the facts have been addressed, the evidence processed and the corresponding arguments presented, COFECE’s Board of Commissioners may issue a resolution as per the law.

The parties to the trial-like procedure are the Economic Agents against whomever the statement of responsibility is issued and the Investigative Authority.
