Trial-like Procedure

When the Investigative Authority determines the existence of evidentiary elements regarding the conduction of a monopolistic practice or unlawful concentration, it turns the file to the Technical Secretariat, for it to notify the statement of probable responsibility to those probable responsible and with that initiate the trial-like procedure.

At this stage, the involved economic agents have the right to argue in their favor and offer evidence related to the presumptive allegations presented against them. Once these statements have been made, the evidence has been submitted and the corresponding arguments has been presented, the Board of Commissioners of COFECE will be able to resolve in accordance with the law.

The parties to the trial-like procedure are, on the one hand, the economic agent or economic agents against whom the statement of probable responsibility is issued and, on the other, the Investigative Authority.
