Study on free market and competition in the expired-patent drug markets in Mexico. COFECE 2017

Patents are important because they stimulate the introduction of better drugs into the market. When granting the right to innovative laboratories to exclude others from the exploitation of the patented invention, for a non-extendable period of 20 years, they incentivize the development of better products. But once the patent expires, other laboratories may produce and trade generic versions, which, theoretically, may discipline the market and make drugs available to a larger public, at a lower price. Generic drug products may be divided into branded generic drugs, (i.e., those identified by their commercial or distinctive name), and unbranded generic drugs (which are commercialized under the generic name that indicates the active substance contained in the product). Additionally, drugs may be classified by the number of suppliers: those having a single supplier are called single-source, and those having more than one supplier in the market are called multiple-source.

La política comercial puede afectar el proceso de libre concurrencia y competencia cuando, de manera injustificada: a. Establece barreras y requisitos de entrada para participar en actividades económicas; b .Impide o restringe las opciones de abasto, en perjuicio de empresas y consumidores; c. Distorsiona las decisiones productivas; d. Disminuye la capacidad de competir, u e. Otorga protección especial a ciertos sectores o propicia tratos diferenciados. Con lo anterior en mente, el presente Cuaderno de promoción de principios de competencia identifica aspectos de la política comercial que podrían restringir la competencia, afectar la posición competitiva de las empresas y disminuir el bienestar del consumidor. Dicho de otro modo, identifica áreas de oportunidad y propone algunas acciones para que dicha política abone al funcionamiento eficiente de los mercados y, de esta manera, contribuya de mejor manera al desarrollo del país.

Trade policy can affect the process of free market participation and competition when, it unjustifiably: a. Establishes entry barriers and requirements to participate in economic activities, b. Restricts or prevents supply options in detriment of companies and consumers, c. Distorts productive decisions, d. Diminishes the capacity to compete, or e. Provides special protection to certain sectors or offers differential treatment. Considering this, this Notebook on the Promotion of Competition Principles identifies the aspects of trade policy that may restrict competition, affect the competitive position of companies and diminish consumer’s welfare. In other words, it identifies areas of opportunity and proposes actionsthat contribute to the efficient functioning of markets and therefore the economic development of the country.

El presente documento tiene por objeto identificar una serie de obstáculos que pudieran afectar la transición hacia mercados competidos de gasolinas y diésel, así como ofrecer propuestas a autoridades de diferentes órdenes e instancias de gobierno para la adopción de políticas públicas que favorezcan la creación de un entorno de competencia. Los obstáculos aquí identificados residen esencialmente en disposiciones jurídicas o en características estructurales de los incipientes mercados mexicanos de gasolinas y diésel. La Comisión Federal de Competencia Económica (COFECE) emite el presente documento como parte de su labor para promover la adopción de principios de libre concurrencia y competencia por parte de las autoridades públicas de todos los órdenes e instancias de gobierno, en mercados de alto impacto en la economía nacional y el bienestar para los consumidores, de conformidad con los criterios establecidos en su Plan Estratégico 2014-2017. Las recomendaciones y propuestas contenidas en el presente documento son exclusivamente en materia de libre concurrencia y competencia económica y se realizan sin considerar otros aspectos de política pública, toda vez que no son competencia de esta autoridad. Lo anterior no limita ni prejuzga las atribuciones de la COFECE para aplicar la LFCE mediante acciones como: i) investigar y sancionar la realización de prácticas monopólicas; ii) prevenir estructuras de mercado que impliquen riesgos a la competencia; y, iii) determinar la existencia de insumos esenciales o barreras a la competencia.

The transition to competitive retail gasoline and diesel markets. COFECE 2017

The goal of the present report is to identify a range of obstacles that might affect the transition to competitive gasoline and diesel markets, as well as to present proposals to authorities at a number of government entities for adopting public policies favoring a competitive environment. The obstacles identified here essentially reside in legal stipulations or in the structural characteristics of incipient Mexican gasoline and diesel markets. Mexico’s Federal Commission for Economic Competition (acronym in Spanish: COFECE) is issuing the present document as part of its work promoting the adoption of free-market-entry and competition principles on the part of public authorities in all government branches and departments, in high impact domestic-economy markets and on behalf of consumer wellbeing, in accordance with criteria established in its 2014-2017 Strategic Plan. The recommendations and proposals contained in the present document deal exclusively with free-market-entry and economic competition and are made without any further consideration of additional public-policy aspects, provided they are not the province of this document’s issuing authority. The above does not limit nor prejudice COFECE’s mandate to apply the Federal Economic Competition Act (acronym in Spanish: LFCE) by means of actions such as: i) investigating and sanctioning monopolistic practices; ii) guarding against market structures that pose risks to competition; and iii) determining the existence of essential facilities or trade barriers.

Miscelánea de obstáculos regulatorios a la competencia, análisis de la normativa estatal

El proyecto “Miscelánea de obstáculos regulatorios a la competencia: análisis de la normativa estatal” es un esfuerzo de la COFECE para promover marcos jurídicos pro-competitivos a nivel local. A través de una revisión sistemática de leyes y reglamentos en las 32 entidades federativas del país, identifica obstáculos regulatorios que podrían afectar la competencia en cinco rubros de gran relevancia para la actividad económica: agropecuario, contratación pública, transporte público, desarrollo urbano y ejercicio profesional. Este esfuerzo constituye un primer paso para identificar potenciales áreas de reforma regulatoria a nivel estatal desde la óptica de la competencia. Este reporte está estructurado de la siguiente manera: primero, el resumen ejecutivo presenta un cuadro que sintetiza y agrupa los obstáculos regulatorios encontrados para los cinco sectores analizados de acuerdo con su efecto en la competencia; posteriormente, cada una de las cinco secciones correspondientes a los sectores analizados, enlista los estados que presentan los obstáculos identificados, y ofrece una breve explicación de cómo la práctica puede limitar la competencia y una propuesta para minimizar su efecto.

En suma, por el impacto que representa la compra de alimentos tanto en el gasto de los consumidores mexicanos, como en su bienestar, además de por su relevancia en la economía nacional, la Comisión Federal de Competencia Económica (Cofece) decidió, en 2014, analizar las condiciones de competencia y libre concurrencia en los mercados de productos agroalimentarios en el país. Alejandra Palacios, Chair of Mexico’s Federal Economic Competition Commission (Comisión Federal de Competencia Económica; COFECE) is the first woman to head the Mexican antitrust authority. Following a major constitutional reform that set forth a new framework for competition in Mexico, Alejandra was appointed by Congress in 2013 to head the COFECE. She was reelected in 2017 for a second four-year tenure that will end in September 2021.

Before her current role at COFECE, Alejandra worked as Project Director at the Mexican Institute of Competitiveness (the Instituto Mexicano para la Competitividad; IMCO) for research projects focused on economic regulation, telecom, public procurement and other issues related to competition.

Since June 2016, she is Vice-President for the International Competition Network (ICN), the most prominent international network on competition, composed of 138 competition authorities around the world, and as of 2017, Member of the Bureau of the Competition Committee of the Organisation for Economic Cooperation and Development (OECD). Alejandra is also a member of the International Women’s Forum, Mexico chapter. In 2019 the Women@Competition organization included her in its list of “40 in their 40s” as one of the 40 most notable women in competition in the Americas, Asia and Europe.

Alejandra holds a bachelor’s degree in Economics, as well as an MBA from the Instituto Tecnológico Autónomo de México (ITAM). She completed a second master’s degree in public policy at the Centro de Investigación y Docencia Económicas (CIDE).

Her academic work includes teaching as well as serving as the Academic Coordinator for the ITAM Economics faculty.
