Posicionamiento respecto a la aprobación del dictamen de simplificación orgánica

En relación con el dictamen aprobado hoy por la Comisión de Puntos Constitucionales de la Cámara de Diputados, la Comisión Federal de Competencia Económica (Cofece) señala lo siguiente:

Primero. El día de hoy la Comisión de Puntos Constitucionales aprobó el dictamen de reforma de simplificación orgánica, la cual incluye la extinción de la Cofece como órgano constitucional autónomo. Este dictamen aún debe ser discutido por los plenos de la próxima legislatura de la Cámara de Diputados, el Senado y los congresos locales. La Cofece los exhorta a una deliberación inclusiva de esta reforma previo a su votación.

Segundo. La Cofece refrenda su disposición a un diálogo más amplio con todos los grupos parlamentarios que integrarán la próxima legislatura del Congreso de la Unión, a fin de abonar a la discusión sobre la importancia de preservar y fortalecer la política de competencia económica en beneficio de los consumidores mexicanos, contemplando un arreglo institucional fuerte para preservar sus principios.

Tercero. Desde su creación, la Cofece ha logrado que la política de competencia económica registre efectos y beneficios históricos en el bienestar de hogares y organizaciones generadoras de empleo.

Lo anterior, mediante la imposición de multas históricas por más de 13 mil millones de pesos a grandes empresas que abusaron de su poder en perjuicio de las y los mexicanos.

Además, ha generado ahorros de al menos 36 mil millones de pesos para los consumidores en productos de necesidad básica como papel higiénico, pañales, gas LP, transporte, pollo, tortillas, huevo, medicinas, gas y gasolinas.

Por cada peso asignado a la Comisión, se han generado 152 pesos en beneficios para el consumidor.

Asimismo, la Cofece ha investigado alrededor de 40% de las industrias en México, lo cual ha generado un aumento anual de 3.3% en la generación de empleos y un crecimiento en los salarios.

Cuarto. En la Cofece estamos conscientes de que aún falta mucho para lograr un México en el que nadie pueda abusar de su poder económico en detrimento del resto de la población. Por ello, desde antes que la iniciativa de simplificación orgánica fuera enviada al Congreso, ya trabajaba con distintas instituciones para contar con más herramientas y lograr una economía que funcionara mejor, con piso parejo y sanciones que disuadieran a quienes quisieran dejar de cumplir la ley.

Quinto. La Cofece confía en que los legisladores de la próxima legislatura valorarán los elementos que se pongan a su consideración para adoptar el mejor modelo para las y los mexicanos. Es indispensable diseñar una reforma que asegure el fomento a la libre competencia y que beneficie a los consumidores, proteja a las micro, pequeñas y medianas empresas, impulse el desarrollo regional y atraiga la inversión.

En tanto, la Cofece seguirá aplicando al máximo las atribuciones de la política de competencia económica, como lo ha hecho hasta ahora, para garantizar la persecución y sanción de prácticas anticompetitivas y contribuir al desarrollo económico incluyente en beneficio de la población.

Alejandra Palacios, Chair of Mexico’s Federal Economic Competition Commission (Comisión Federal de Competencia Económica; COFECE) is the first woman to head the Mexican antitrust authority. Following a major constitutional reform that set forth a new framework for competition in Mexico, Alejandra was appointed by Congress in 2013 to head the COFECE. She was reelected in 2017 for a second four-year tenure that will end in September 2021.

Before her current role at COFECE, Alejandra worked as Project Director at the Mexican Institute of Competitiveness (the Instituto Mexicano para la Competitividad; IMCO) for research projects focused on economic regulation, telecom, public procurement and other issues related to competition.

Since June 2016, she is Vice-President for the International Competition Network (ICN), the most prominent international network on competition, composed of 138 competition authorities around the world, and as of 2017, Member of the Bureau of the Competition Committee of the Organisation for Economic Cooperation and Development (OECD). Alejandra is also a member of the International Women’s Forum, Mexico chapter. In 2019 the Women@Competition organization included her in its list of “40 in their 40s” as one of the 40 most notable women in competition in the Americas, Asia and Europe.

Alejandra holds a bachelor’s degree in Economics, as well as an MBA from the Instituto Tecnológico Autónomo de México (ITAM). She completed a second master’s degree in public policy at the Centro de Investigación y Docencia Económicas (CIDE).

Her academic work includes teaching as well as serving as the Academic Coordinator for the ITAM Economics faculty.
