Position on the transition period from Cofece to the new competition authority

To give continuity to the substantive procedures that are currently underway, the Federal Economic Competition Commission (Cofece) seeks an orderly and articulated transition to the new competition authority, established in the reform on organic simplification.

In this regard, Cofece will continue to proactively seek dialogue with all the government entities involved, to establish an adequate closure program, in which sufficient resources for the continuity of due process and investment certainty are guaranteed, meanwhile, the Congress of the Union deliberates and approves the secondary legislation in our country and the new strong competition authority is created, with a robust policy that favors the welfare of Mexicans and the economic development of the country.

BY THE NUMBERS

During January, the Commission dealt with 117 matters, of which 65 correspond to mergers, 27 to proceedings for monopolistic practices and unlawful mergers, 5 to special proceedings, and 20 to opinions on bidding processes, concessions, and permits.

Complaints, investigations, and trial-like proceedings

  • 3 complaints were admitted and analyzed in January, and they remained pending at the end of the month.
  • 19 investigations for monopolistic practices and unlawful mergers were followed-up.
  • 5 trial-like proceedings were followed up one of which initiated during the period.
  • 5 special procedures were followed up to determine the existence of essential facilities and barriers to competition.

Mergers

  • 65 mergers were monitored, of which 19 were notified during the period. Of these transactions, 6 were authorized, accordingly, 59 remained under analysis at the end of the month.
  • The amount of authorized transactions was $360,423.7 million pesos.

Amparo trials

  • During December, the Judicial Power resolved 3 amparo trials: 1 was granted, 1 was denied and 1 was dismissed.At the end of the period, 385 trials are still in process, of which 355 correspond to economic competition matters.

Of which it is reported that the court that finally resolved and the file number of the dismissed amparo trial is: First District Court in Administrative Matters, Specialized in Economic Competition, Broadcasting, and Telecommunications, with residence in Mexico City and jurisdiction over the entire Republic, Exp. 165/2022; of the amparo trial granted is: First Collegiate Circuit Court in Administrative Matters Specialized in Economic Competition, Broadcasting, and Telecommunications, with residence in Mexico City and jurisdiction over the entire republic, R.A. 199/2024, and of the amparo trial denied is: First District Court in Administrative Matters Specialized in Economic Competition, Broadcasting, and Telecommunications, with residence in Mexico City and jurisdiction over the entire Republic, Exp. 51/2024.

During 2024, within the framework of the new phase of competition policy, Cofece carried out several actions to promote and guarantee market conditions that benefit the population.
